General Terms & Conditions and Website Terms of Use

Last updated: September 1, 2026

Effective Date: September 1, 2026 · Version 2.0 · Last Updated: September 1, 2026

1. Acceptance of These Terms

These General Terms & Conditions and Website Terms of Use (these "Terms") govern your access to and use of www.gtipetro.com (the "Site") and, together with any signed proposal, order, or program-specific terms, your purchase of products and services from Genesys Technologies Inc., a California corporation doing business as GTI Petro ("GTI Petro," "we," "us," or "our").

By using the Site or purchasing our products or services, you agree to these Terms. If you do not agree, do not use the Site or our services. If you are agreeing on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" means that entity.

2. Definitions

"Customer" or "you" means the person or entity that uses the Site or that purchases, or seeks a proposal for, products or services from GTI Petro.

"Proposal" means any proposal, quotation, estimate, bid, or order form issued by GTI Petro.

"Program Terms" means the terms specific to a particular offering, including our Service Terms & Conditions and our Loyalty & Maintenance Program Terms.

"Services" means any work, labor, materials, equipment, inspection, monitoring, or support furnished by GTI Petro.

"Site" means www.gtipetro.com and any related web pages, forms, or portals we operate.

3. Order of Precedence

If there is a conflict among documents, the following order controls, from highest to lowest: (1) a written agreement or Proposal signed by both parties; (2) the applicable Program Terms; (3) these Terms. The Privacy Policy and SMS Terms & Conditions apply in addition to, and are incorporated by reference into, all of the above.

4. Use of the Site

The Site is intended for business use. You may use the Site only for lawful purposes and in accordance with these Terms. You will not:

  • interfere with or disrupt the Site, its security, its servers, or its networks;
  • attempt to gain unauthorized access to any system, account, or data;
  • copy, scrape, harvest, mine, frame, mirror, or reverse-engineer the Site or its content, or use any automated system to access it in a manner that sends more requests than a human could reasonably produce;
  • use the Site to infringe the rights of others or to transmit unlawful, harmful, deceptive, or misleading content;
  • introduce any virus, malware, or other harmful code; or
  • use the Site or its content for competitive benchmarking without our written consent.

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms.

5. Requests, Forms and Electronic Communications

Submitting a service request, quote request, or contact form through the Site does not create a contract, dispatch a technician, or begin a service response. A binding agreement is formed only as described in the applicable Program Terms.

Do not use the Site to report an emergency. If you have a fuel leak, a fire or safety hazard, a spill, or any condition that endangers people, property, or the environment, call 911 and then call GTI Petro at 1-888-450-0484.

You consent to receive communications from us electronically, including by email and, where you have opted in, by text message. You agree that electronic records, notices, disclosures, and signatures satisfy any legal requirement that such communications be in writing, and that an electronic signature has the same legal effect as a handwritten signature under the federal E-SIGN Act and the California Uniform Electronic Transactions Act. You may withdraw consent to transact electronically by contacting us, though doing so may prevent us from providing certain services.

6. Intellectual Property

The Site and its content — including text, graphics, photographs, layout, software, logos, the GTI PETRO name and mark, and the tagline "Gas Doesn't Pump Itself" — are owned by GTI Petro or its licensors and are protected by United States and international intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to view and print pages of the Site for your internal business purposes. All rights not expressly granted are reserved. You may not use our name, marks, or logos without our prior written consent.

Drawings, specifications, site surveys, schedules of values, pricing, methods, and other materials prepared by GTI Petro remain our property and are furnished for the limited purpose of evaluating and performing the applicable Services. They may not be reused on other projects, disclosed to our competitors, or used to solicit our subcontractors, suppliers, or vendor relationships.

7. Third-Party Links and Content

The Site may contain links to third-party websites, tools, and services, including our loyalty program enrollment and pricing portal. We provide these links for convenience only. We do not control third-party sites, we are not responsible for their content, security, availability, or privacy practices, and a link is not an endorsement. Your dealings with any third party are solely between you and that third party.

8. No Professional or Regulatory Reliance

Information on the Site — including descriptions of services, compliance topics, underground storage tank requirements, testing intervals, and regulatory summaries — is provided for general informational purposes only. It is not engineering, environmental, legal, tax, or compliance advice, and it is not a substitute for the requirements of the agency having jurisdiction over your site. Codes and regulations change and vary by jurisdiction.

You remain responsible for your own regulatory compliance. Any Services we perform are governed by the specific written Proposal or Program Terms for that work.

9. Disclaimer of Warranties (Site)

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site is complete or current.

This Section 9 applies to the Site only. Warranties for Services we actually perform are stated in the applicable Program Terms and are not disclaimed here. See the Service Terms & Conditions and the Loyalty & Maintenance Program Terms.

10. Limitation of Liability (Site)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GTI PETRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST FUEL SALES, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING FROM OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total aggregate liability arising out of or relating to your use of the Site will not exceed one hundred dollars ($100).

This Section 10 applies to the Site only. Liability limits for Services we perform are stated in the applicable Program Terms, which provide substantially higher limits. Nothing in this Section limits liability that cannot be limited under applicable law.

11. Indemnification

You will indemnify, defend, and hold harmless GTI Petro and its officers, directors, employees, and agents from and against any third-party claim, damage, loss, liability, cost, or expense (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

Nothing in this Section requires you to indemnify GTI Petro for liability arising from GTI Petro's own negligence or willful misconduct, and this Section does not apply to Services, which are governed by the mutual indemnity provisions of the applicable Program Terms.

12. Privacy and Communications

Your use of the Site is also governed by our Privacy Policy and, if you opt in to text messaging, our SMS Terms & Conditions, each available at www.gtipetro.com and each incorporated into these Terms by reference.

We do not sell or rent personal information, and mobile opt-in data and SMS consent are never shared with third parties or affiliates for their marketing purposes.

13. Copyright Complaints (DMCA)

If you believe content on the Site infringes your copyright, send a written notice to our designated agent containing the information required by 17 U.S.C. § 512(c)(3): your physical or electronic signature; identification of the copyrighted work; identification of the material claimed to be infringing and where it is located on the Site; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and you are authorized to act on the owner's behalf.

Designated Copyright Agent: Genesys Technologies Inc. d/b/a GTI Petro, Attn: Copyright Agent, 5352 N. Irwindale Ave., Suite C, Irwindale, CA 91706. Email: info@gtipetro.com. Phone: 1-888-450-0484.

We will respond to valid notices in accordance with the Digital Millennium Copyright Act and may terminate the access of repeat infringers.

14. Licensing and Regulatory Status

GTI Petro is a licensed contractor in the states where it performs work. Our contractor license numbers for California, Arizona, and Nevada appear on every proposal, contract, estimate, and invoice we issue, and are available on request at info@gtipetro.com.

Licensure information may be verified with the California Contractors State License Board (www.cslb.ca.gov), the Arizona Registrar of Contractors (roc.az.gov), and the Nevada State Contractors Board (www.nvcontractorsboard.com).

15. Governing Law, Venue and Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of California, without regard to conflict-of-laws principles. For Services, governing law is determined by the applicable Program Terms, which generally apply the law of the state in which the work is performed.

Before filing any action, the parties will first attempt in good faith to resolve the dispute through direct discussion between senior representatives and, if that does not resolve it within thirty (30) days, through non-binding mediation before a mutually agreed mediator, with the parties sharing the mediator's fees equally. This requirement does not prevent either party from seeking injunctive relief, or from recording or enforcing a mechanics lien, stop payment notice, or bond claim within any statutory deadline.

The exclusive venue for any dispute not resolved through mediation is the state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction. EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY TO THE EXTENT PERMITTED BY LAW. In any action or proceeding to enforce or interpret these Terms, the prevailing party is entitled to recover its reasonable attorneys' fees and costs.

We do not require our customers to arbitrate, and we do not ask you to waive your right to participate in a class or representative action.

16. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date and version number above and post the current version at www.gtipetro.com. Your continued use of the Site after a revision is posted constitutes acceptance of the updated Terms.

For customers with an active subscription or open project, we will provide notice of material changes as described in the applicable Program Terms before those changes take effect. We do not apply material changes retroactively to work already performed or to a term you have already paid for.

17. Miscellaneous

Entire Agreement. These Terms, together with any signed Proposal and the applicable Program Terms, are the entire agreement regarding your use of the Site and supersede all prior proposals, negotiations, and representations on that subject.

Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or if it cannot be, severed, and the remaining provisions stay in full force.

Waiver. No waiver is effective unless in writing, and no delay in enforcing a right waives it.

Assignment. You may not assign these Terms without our prior written consent. We may assign to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets, and may subcontract portions of the Services.

Notices. Notices to GTI Petro must be in writing and sent to 5352 N. Irwindale Ave., Suite C, Irwindale, CA 91706, or to info@gtipetro.com. Notices to you may be sent to the address, email address, or phone number on file for your account.

No Third-Party Beneficiaries. These Terms benefit only the parties and their permitted successors and assigns.

Force Majeure. Neither party is liable for any failure or delay in performance (other than payment obligations) caused by events beyond its reasonable control.

Survival. Sections addressing intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution survive termination.

Headings. Headings are for convenience only and do not affect interpretation.

Counterparts and Electronic Signatures. Any agreement referencing these Terms may be executed in counterparts and by electronic signature, each of which is deemed an original.
