Introduction
Genesys Technologies Inc., a California corporation doing business as GTI Petro ("GTI Petro," "we," "us," or "our"), respects your privacy. This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, how long we keep it, and the choices and rights you have.
This Policy applies to www.gtipetro.com, our online forms and enrollment portals, our text-message program, and the information we collect in the course of quoting, performing, billing, and supporting our services. It does not apply to third-party websites we link to, or to information you provide directly to a manufacturer, payment processor, or financing company under its own policy.
We are a business-to-business company. Our services are sold to fuel retailers, station operators, fleet operators, dealers, and property owners for commercial purposes. Most of the personal information we handle is business contact information about the people who work at our customer and vendor companies.
1. Information We Collect
Contact and business information. Name, job title, company name, business mailing address, site address, email address, and telephone and mobile numbers.
Transaction and account information. Proposals, quotes, purchase orders, work orders, service history, equipment and site records, subscription plan and enrollment records, invoices, payment status, and credit application information. Payment card and bank account details are collected and processed by our payment processor; we do not store full payment card numbers on our systems.
Service and site information. Equipment make, model and serial numbers, inspection and diagnostic results, photographs of equipment and work areas, technician notes, compliance and testing records, and — where applicable — tank monitoring and point-of-sale system data.
Communications. Emails, text messages, web form submissions, and records of phone calls with our office and dispatch, including notes of what was requested and what was done. Where we record or monitor calls for quality and training, we do so only as permitted by law and you will be notified at the start of the call.
Consent records. When you opt in to text messages or accept terms electronically, we record the fact, date, time, method, and the version of the terms presented, so we can demonstrate what you agreed to.
Technical and usage information. IP address, browser type and version, device type, operating system, referring page, pages viewed, and dates and times of access, collected through cookies, analytics tools, and server logs.
Employment information. If you apply for a job with us, we collect the information in your application and any information you authorize us to obtain. Applicant and employee information is handled under our internal employment privacy notice, which is available on request, and is not the subject of this Policy.
Information we do not collect. We do not knowingly collect Social Security numbers, government identification numbers, precise device geolocation, biometric data, health information, or information about racial or ethnic origin, religion, sexual orientation, union membership, or immigration status through our website. Please do not send us this information.
2. Where the Information Comes From
We collect personal information: directly from you, when you contact us, request a quote, enroll in a program, or authorize work; automatically, from your use of our website; from your employer or the site owner or operator, when they engage us for work at your site; from our service providers, including our website host, analytics provider, messaging platform, and payment processor; and from publicly available and commercial sources, such as business registries and credit reporting agencies, in connection with a credit application.
3. How We Use Personal Information
We use personal information to:
- respond to inquiries, prepare proposals, and schedule and dispatch service;
- perform, document, and support the services you purchase, including inspections and compliance reporting;
- bill you, process payments, extend credit, and collect amounts owed;
- administer subscriptions, including enrollment, renewal reminders, and cancellation requests;
- send service and transactional communications, such as appointment confirmations, dispatch updates, invoices, and safety or recall notices;
- send marketing communications about our services, where you have not opted out and, for text messages, where you have opted in;
- operate, secure, maintain, and improve our website and systems;
- maintain business records, resolve disputes, enforce our agreements, and preserve lien and bond rights; and
- comply with legal, regulatory, tax, insurance, and safety obligations.
We do not use personal information to make automated decisions that produce legal or similarly significant effects about you, and we do not profile you for those purposes.
4. Cookies and Tracking Technologies
Our website uses cookies and similar technologies. Strictly necessary cookies allow the site to load, keep it secure, and remember your choices; the site does not function without them. Analytics cookies help us understand which pages are visited and how the site performs. Functional cookies remember preferences such as a region or a form you started.
You can control cookies through your browser settings, including blocking or deleting them. Blocking strictly necessary cookies may prevent parts of the site from working.
Do Not Track and Global Privacy Control. Our website does not currently respond to browser "Do Not Track" signals, because no common standard for them has been adopted. We do honor an opt-out preference signal such as Global Privacy Control where the law requires us to and where our website is able to detect it. Because we do not sell or share personal information for cross-context behavioral advertising, there is nothing for such a signal to turn off.
5. How We Share Personal Information
We share personal information only as described here:
Service providers. Companies that perform work on our behalf under contract and are permitted to use the information only for that purpose — website hosting, IT support, analytics, email and text-message delivery, accounting and billing, payment processing, document storage, and shipping.
Subcontractors and trade partners. Where a project requires an electrician, concrete contractor, tank tester, environmental consultant, or similar trade partner, we share the site and contact information necessary for them to perform.
Manufacturers and equipment vendors. Where a warranty claim, parts order, registration, or technical escalation requires it.
Site owners, operators, tenants, and property managers. Where we are engaged by one and the work affects another, or where compliance documentation must be delivered to the responsible party.
Regulators and agencies having jurisdiction. Including local fire authorities, building departments, air districts, and underground storage tank authorities — the applicable CUPA in California and the corresponding state or local authority in Arizona and Nevada — where compliance reporting or inspection requires it.
Professional advisors, insurers and lenders. Our attorneys, accountants, insurers, and, where a customer arranges financing, that customer's lender.
Legal and safety. Where required by law, subpoena, or court order; to establish, exercise, or defend legal claims, including recording and enforcing mechanics liens; and where we believe in good faith that disclosure is necessary to protect the safety of any person or to prevent fraud.
Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to reasonable confidentiality protections.
6. We Do Not Sell or Share Your Personal Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We have not done so in the preceding twelve months. We do not rent, trade, or provide your personal information to third parties for their own marketing or promotional purposes.
Mobile and SMS data. No mobile information, including telephone numbers, collected through SMS opt-in, and no consent to receive text messages, will be shared with any third party or affiliate for its marketing or promotional purposes. Text-messaging originator opt-in data and consent are excluded from every category of information sharing described in this Policy, other than sharing with the messaging platform provider that delivers the messages on our behalf.
7. How Long We Keep Information
We keep personal information only as long as we need it, and no longer than the periods below unless a law, contract, insurance requirement, or an actual or anticipated legal claim requires us to keep it longer.
| Category | Retention |
|---|---|
| Website inquiries and quote requests that do not become customers | Up to 24 months from last contact |
| Customer contact and account records | Duration of the relationship, then 7 years |
| Proposals, contracts, work orders and service records | 10 years from completion, to match warranty, lien and construction-defect periods |
| Invoices, payment records and tax records | 7 years |
| Text-message consent and opt-out records | At least 4 years from the date consent is given or revoked |
| Electronic acceptance records for terms and subscriptions | At least 3 years, or 1 year after the subscription ends, whichever is longer |
| Website analytics and server logs | Up to 26 months |
| Call recordings, where made | Up to 12 months |
| Job applications from candidates not hired | 3 years |
When a retention period ends, we securely delete the information or de-identify it so it can no longer reasonably be linked to you.
8. How We Protect Information
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encrypted transmission of our website, access controls limiting information to the people who need it, vendor due diligence and written confidentiality obligations, and staff training. No method of transmission or storage is one hundred percent secure, and we cannot guarantee absolute security. If a breach of your personal information occurs, we will notify you and the appropriate authorities as required by law.
9. Your Choices
Marketing email. Use the unsubscribe link in any marketing email, or email us. We will continue to send transactional and service messages relating to work you have purchased.
Text messages. Reply STOP to any message, or contact us by any other reasonable means, including by email or by telling our office. See our SMS Terms & Conditions.
Cookies. Manage them in your browser settings.
Update your information. Email or call us and we will correct your records.
10. Your Privacy Rights
We honor the rights described below for every individual who asks, regardless of where they live and regardless of whether a particular privacy statute applies to us. Where a statute does apply, we honor it on its terms.
You may ask us to:
- Know and access — tell you the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties we disclosed it to;
- Correct — fix inaccurate personal information;
- Delete — delete personal information we collected from you, subject to exceptions such as completing a transaction, providing a warranted service, security, legal compliance, and our own record-retention obligations;
- Opt out of sale or sharing — we do not sell or share personal information, so there is nothing to opt out of, but you may confirm this with us in writing;
- Limit the use of sensitive personal information — we do not collect or use sensitive personal information beyond what is necessary to provide our services; and
- Be free from retaliation — we will not deny you services, charge you a different price, or provide a different level of quality because you exercised a privacy right.
How to Submit a Request
Use either method. Both are free.
- Email: info@gtipetro.com with the subject line "Privacy Request"
- Phone: 1-888-450-0484
We will acknowledge your request promptly and respond within 45 days, and will tell you if we need an additional 45 days. Before we act on a request, we will take reasonable steps to verify your identity — usually by confirming information we already hold — so that we do not disclose your information to someone else. An authorized agent may submit a request on your behalf with written proof of authorization; we may also ask you to confirm the agent's authority directly.
California Residents
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives the rights listed above to consumers of businesses that meet the statute's thresholds. We honor those rights as described in this Policy. The categories of personal information we have collected in the preceding twelve months are: identifiers (name, business address, email, telephone number, IP address); customer records information under California Civil Code § 1798.80 (business contact details, payment and billing information); commercial information (services purchased, service and transaction history); internet and network activity information (website usage); geolocation limited to the business or service address; audio information where a call is recorded; and professional or employment-related information (job title and employer). We collect these from the sources listed in Section 2, for the purposes listed in Section 3, and disclose them to the categories of recipients listed in Section 5. We have not sold or shared personal information in the preceding twelve months.
Nevada Residents
Nevada law (NRS 603A.300–603A.360) allows a Nevada consumer to submit a verified request directing an operator of a website not to sell certain covered information. GTI Petro does not sell covered information for monetary consideration. Our designated request address for Nevada opt-out requests is info@gtipetro.com, subject line "Nevada Privacy Request." We will respond within sixty (60) days, and will tell you if we need an additional thirty (30) days.
Residents of Other States
Several other states give residents rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising, the sale of personal information, and certain profiling. If you are a resident of one of those states, use the request methods above and tell us which state you live in. We will honor your rights on the terms this Policy describes. If we deny a request, you may appeal by replying to our response with the word "Appeal"; we will respond to the appeal within forty-five (45) days and tell you how to contact your state attorney general if you disagree.
11. Children's Privacy
Our website and services are directed to businesses and are not intended for children. We do not knowingly collect personal information from anyone under 18 years of age, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a child has provided us information, contact us and we will delete it.
12. Third-Party Links
Our website links to third-party sites and services, including our loyalty program enrollment and pricing portal. Those services operate under their own privacy policies, which we encourage you to read. We are not responsible for their practices.
13. Information Handled on Behalf of Our Customers
When we service equipment at a customer's site, we may handle transaction, tank monitoring, or point-of-sale data belonging to that customer. We handle that information only as directed by the customer and only as necessary to perform the services, and we do not use it for our own marketing.
14. Changes to This Policy
We may update this Policy from time to time. When we do, we will change the "Last Updated" date and version number above and post the current version at www.gtipetro.com. If we make a material change to how we handle personal information, we will provide notice by email or by a conspicuous notice on our website before the change takes effect. Prior versions are available on request.
